MORTGAGE COMPLIANCE SPECIALIST (PARTTIME)

JOB DESCRIPTION



OVERVIEW: Are you an experienced mortgage compliance specialist that feels they are not growing in their current position as quickly as they should Do you seek a parttime compliance position with the opportunity to grow Perhaps you should consider growing with Castle Rock.


Castle Rock Capital Funding is a Florida mortgage brokerage that was started by experienced lenders earlier this year to provide a much better experience for our associates and our customers. We seek an experienced parttime compliance specialist that will help us grow by managing all things compliance and NMLS on behalf of our company. If you re out of compliance your out of business and we need a qualified person to help us navigate the compliance minefield to keep us growing in a compliant manner.


This will start as a remote position working 8hours on Friday s and 8Hours on Mondays but will morph over time as the company grows. The intention is to have this person s role grow as we grow. We re currently closing 710 loans per week but we feel we ll be closing 1520 each week by yearend


Here is what we are asking the successful candidate to do.


Hours: 16 Hours per Week (8 hours Friday and 8 hours on Monday)


FIRST 34 MONTHS: The successful candidate will spend their first few weeks staying on top of current files but also working backwards to ensure our company is fullycompliant. The priorities for the candidate over the first several weeks are:

· Priority 1: Review Each Closed Loan File to ensure compliance with all State and Federal Laws and regulations. In order to be paid for a loan file the MLO must provide a complete and compliant file. The compliance specialist will review each file to ensure compliance and authorize accounting to pay the MLO for the transaction.

· Priority 2: Work backward through our closed loans to ensure that those files are compliant and audit ready . This will take several weeks but will be an ongoing part of the role.

· Priority 3: Maintain Transaction Journal and Call Reports. Make sure call reports are complete and filed in a timely manner. This will include going back through past Transaction Journals to make sure all entries are correct.

· Priority 4: Create and maintain all compliance procedures and rules. Communicate regularly with Principal Broker to build airtight compliance system for the company.

· Priority 5: Review and Maintain the Advertising File for Compliance.


ALL THINGS NMLS:

· The successful candidate will have a great deal of experience navigating the NMLS. They will be the goto person for all things NMLS and will manage the NMLS for our company.

· Manage the NMLS filings onboarding termination filings and all other NMLS filings for the company.


INTERACT WITH REGULATORS:

· Prepare for and Oversee Audits

· Compile and File Call Reports

· Serves as company s officer for BSA AML CIP and other regulatory requirements

· Keep current with and understand all rules and regulations that the company needs to comply with. You will be the person that ensures that we are compliant with all laws rules and regulations as a company.

· Know when new laws rules and regulations come into existence and ensure the company is complying with them.

· The successful candidate s success in the role will largely be determined by the company s overall performance in audits.


MANAGE LICENSING FOR MLOS AND THE COMPANY:

· Currently we are only licensed in Florida but will oversee and apply for other state licenses as required.

· Ensure that all company and employee licenses are current and renewed

· Track all MLO licenses and continuing ed to ensure that they are compliant. Send out reminders to licensed employees regarding continuing ed and renewals.

· The subjectmatter expert on all things NMLS. Handles all use of and filings on the NMLS on the company s behalf.

· Assists in the onboarding and termination process with MLOs and other employees by managing the NMLS portion of the process for the company.


SET MONITOR AND ENFORCE POLICIES AND PROCEDURES:

· Stay current with all industry rules and regulations

· Monitor all loan applications and files to ensure compliance with all industry rules and regulations

· Ensure that all company employees are aware of and adhere to industry rules and regulations

· Answer compliance questions from employees. If you don t know the answer be able to research to discover the answer.

· Set maintain communicate and police all policies and procedures for the company

· Monitor and approve all advertising letterhead email signatures and all other customerfacing items to ensure compliance.

· Responsible for the company s quality control process

· Will serve as an admin for our LOS and marketing systems to ensure our compliance with all rules and regulations. Must update systems accordingly to keep us compliant.

· The role will require the successful candidate to learn the ins and outs of our Loan Operating System Arive.


DATA SECURITY:

· Ensure that all data and file storage is secure and done in compliance with all rules and regulations.


ADVERTISING APPROVAL:

· Approve all advertising and customerfacing information such as websites email signatures etc. to ensure that all rules and regulations are being adhered to.

· We currently use the marketing system SureFire. We ll ask you to review the marketing materials that are available to LOs tweak the materials that need to be tweaked and approve all marketing materials that are distributed by the company. You will be an admin for our systems to update them to ensure compliance.

· Work with marketing to ensure that all materials they produce and send out are compliant.


As we mentioned we re growing and adding staff as we do. We will likely ask the successful candidate to assist with such items as researching compliant health insurance or other items a growing company might need assistance with. As we grow so will our staff. It is our intention that the successful candidate will continue to grow in their job responsibilities and over time be a key executive with the company.

REQUIREMENTS:

· Minimum 1 year of compliance experience with a mortgage lender

· A valid and active Florida NMLS license

· Be wellversed and adept with all NMLS operations you will be responsible for handling all NMLS transactions on behalf of the company

· Experience preparing for and going through regulatory audits. We will mainly be assessing your job performance on the results of our audits and overall compliance as a company. You will be the responsible person in our company to ensure that we are in compliance.

· Have experience compiling and filing call reports on behalf of mortgage companies.

· Willingness and Ability to speak truth to power. By this we mean you must be able to tell even the highest levels within our company that they are out of compliance and hold them accountable for staying in compliance.

· There will be times when you must be the bad person in keeping us in compliance. Must be comfortable with professionally handling touchy situations where you stand your ground in keeping our company in compliance.
